The Myers Firm started 2020 off with a large settlement for a carman working for a major commuter railroad in the northeast United States. The employee was injured when he was tasked with moving a heavy object by himself. The carman was using proper lifting methods and was performing the job as he had been trained. Unfortunately, due to the weight of the object, while performing his job the carman injured his lumbar spine which ultimately required two surgeries.
The Myers Firm filed suit in state court suing the carman’s railroad employer. Depositions were taken of the carman, multiple witnesses to the incident, and multiple railroad supervisors. The case went to mediation; however, a settlement was unable to be reached that day. Negotiations continued over the following weeks andThe Myers Firm was able to secure a $1,250,000 settlement for the carman.
